Min Hee Jin’s team is pushing once again for her return as CEO of ADOR after the Seoul Central District Court dismissed her injunction request against HYBE.
On October 29, Min’s team released a statement about the court’s decision, explaining that the dismissal wasn’t a rejection of her claims but rather a procedural decision.
The team clarified, “The court ruled that, even if HYBE instructs ADOR’s directors on specific tasks, the directors aren’t legally bound to follow. This was a procedural dismissal, not a rejection of the shareholders' agreement between HYBE and Min Hee Jin.”
Min Hee Jin’s team emphasized that her CEO term with ADOR is valid until November 1, 2026. They stated, “We request that ADOR’s directors appoint her as CEO at the upcoming board meeting on the 30th. If HYBE or ADOR directors appointed by HYBE do not reinstate her, Min Hee Jin will consider her rights under the shareholders' agreement regarding HYBE’s contract breach.”
The court explained that HYBE’s instructions to ADOR’s directors aren’t legally enforceable, so issuing an injunction wouldn’t have any legal effect.
They also mentioned the "procure" clause, which says shareholders should ensure actions by directors they appoint but noted that enforcing this clause conflicts with certain business principles, needing further review in the main lawsuit.
HYBE responded to the court’s decision, saying, “We respect the court’s wise decision. HYBE will focus on stabilizing ADOR, enhancing multi-label management, and supporting artist activities.”
Earlier, on September 13, Min Hee Jin had filed for an injunction for an ADOR shareholders' meeting and her reinstatement as an internal director. She was reappointed on September 17.
